OVERVIEW

Welcome to WellSpring! The words "we", "us" and "our" mean WellSpring. WellSpring runs this store and website, including all its information, content, features, tools, products and services (together, the "Services"). WellSpring is powered by Shopify, which helps us provide the Services to you.

These terms, together with the policies mentioned in them (together, the "Terms"), explain your rights and duties when you use the Services. Please read them carefully. They include important points about warranties and our limits of liability.

By visiting or using our Services, you agree to these Terms and to our Privacy Policy, Return & Refund Policy, and Shipping Policy. If you do not agree, please do not use our Services.

1. ACCESS AND ACCOUNT

You must be at least 18 years old to buy from us. If you are under 18, you may use the Services only with the involvement of a parent or guardian.

To browse or buy, we may ask for your name, phone number, email address, delivery address, and payment details. You confirm that everything you give us is correct, current and complete.

You are responsible for keeping your account login safe and for everything done through your account. You may not sell, transfer or share your account with anyone else.

2. OUR PRODUCTS

We try to show our products as accurately as we can. Colours and appearance may look different on your screen because of your device and its settings.

Our products are wellness products. They are not medicines and are not meant to diagnose, treat, cure, or prevent any disease. They do not replace advice from a doctor. If you have a medical condition or are unsure whether a product is right for you, please speak to a doctor before using it.

We may change product descriptions, stop selling a product, or limit the quantity per customer at any time.

3. ORDERS

When you place an order, you are making an offer to buy. Your order is accepted only when we confirm it.

Order confirmation for COD (Cash on Delivery): For COD orders, we may contact you by phone, WhatsApp, or SMS to confirm your order before we ship it. If we cannot reach you, or you do not confirm, we may cancel the order.

We may also cancel or refuse an order for reasons such as: a wrong price or product description, the product being out of stock, an address we cannot deliver to, a suspected fake or fraudulent order, or a payment problem. If we cancel an order after you have paid, we will refund the full amount.

All purchases are for your personal use only, not for resale.

4. PRICES AND PAYMENT

All prices are in Indian Rupees (INR) and include GST, unless we clearly say otherwise. The price you pay is the price shown when you place the order, and it will appear in your order confirmation.

We accept the payment methods shown at checkout, such as COD, UPI, cards, and wallets. Prepaid payments are handled by third-party payment providers. You confirm that you are allowed to use the payment method you choose.

Prices, discounts and offers can change at any time without notice. If a special offer has its own terms, those terms apply to that offer.

5. SHIPPING AND DELIVERY

Delivery times shown on our store are estimates, not guarantees. Delays can happen because of courier partners, weather, local restrictions, or other events outside our control. Please read our Shipping Policy for full details, including what happens if a parcel is delayed, lost, or cannot be delivered.

Please make sure your address and phone number are correct. If a parcel cannot be delivered because of a wrong address or because you cannot be reached, we may not be able to ship it again.

6. RETURNS AND REFUNDS

Returns, refunds and cancellations are handled only as explained in our Return & Refund Policy.

7. INTELLECTUAL PROPERTY

Everything on our Services, including the name WellSpring, logos, text, images, graphics, videos, and the design of the store, belongs to WellSpring or its licensors. It is protected by Indian law, including the Copyright Act, 1957 and the Trade Marks Act, 1999.

You may use the Services for your own personal, non-commercial use only. You may not copy, reproduce, share, edit, republish, or sell any part of our content without our written permission. You may not use our name, logos, or slogans without our written permission.

Shopify's name and logo belong to Shopify. All other names and logos on the Services belong to their owners.

8. THIRD-PARTY TOOLS AND LINKS

Our Services may include tools or links offered by other companies. We do not control them and are not responsible for their content, accuracy, or policies. Using them is your own choice and risk. If you have a problem with a third-party product or service, please contact that third party.

9. RELATIONSHIP WITH SHOPIFY

WellSpring is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with WellSpring. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and WellSpring, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with WellSpring.

10. PRIVACY

The personal information we collect is covered by our Privacy Policy. Because our store is hosted by Shopify, Shopify also collects and processes some information about how you use the Services. Your information may be shared with Shopify and with other service providers (such as payment and delivery partners), some of whom may be outside India. Please read our Privacy Policy for details.

11. FEEDBACK AND REVIEWS

If you send us ideas, suggestions, reviews, or other content ("Feedback"), you allow us to use it for free, anywhere, and for any purpose, including advertising, with no payment to you.

You confirm that your Feedback is your own, is true, and does not break any law or anyone's rights. It must not include abusive, unlawful, or false content, or any virus or harmful code. We may remove any Feedback we find unlawful, offensive, or against these Terms, but we are not required to.

12. ERRORS AND MISTAKES

Sometimes our store may contain typing errors or wrong information about prices, descriptions, offers, or stock. We may correct these mistakes at any time. If a mistake affects your order, we will contact you, and if we cancel the order, we will refund any amount you have paid.

13. PROHIBITED USES

You may use the Services only for lawful purposes. You must not:
- Break any law or anyone's rights while using the Services
- Give false or misleading information
- Pretend to be another person or business
- Harass, abuse, or threaten anyone
- Upload viruses or harmful code
- Send spam or unwanted promotional messages

- Use bots, scrapers, or automatic tools to access or copy the Services, or try to get around our security measures

We may suspend or block your access if you break these rules.

14. TERMINATION

We may stop or suspend your access to the Services at any time if you break these Terms. You will still have to pay any amount you owe up to that date. Sections that by their nature should continue (such as Intellectual Property, Disclaimer, Limitation of Liability, Indemnification, and Governing Law) will continue after termination.

15. DISCLAIMER OF WARRANTIES

The information on our Services is for general information only. We do not promise that it is always complete, accurate, or up to date.

Except as clearly stated by us, the Services and products are provided "as is" and "as available". We do not promise that the Services will always work without interruption or errors.

Nothing in these Terms takes away any rights you have as a consumer under Indian law, including the Consumer Protection Act, 2019.

16. LIMITATION OF LIABILITY

To the fullest extent allowed by law, WellSpring, its owners, partners, staff, and service providers (and Shopify and its affiliates) are not liable for indirect, incidental, special, or consequential losses, or for loss of profits, data, or savings, arising from your use of the Services or our products.

Where the law allows, our total liability for any claim related to a product is limited to the amount you paid for that product. This does not limit any right you have under Indian consumer law.

17. INDEMNIFICATION

You agree to cover WellSpring, Shopify, and our partners and staff for any losses, claims, or costs (including reasonable legal fees) caused by your breaking these Terms, breaking any law, or breaking someone else's rights.

18. SEVERABILITY, WAIVER AND ENTIRE AGREEMENT

If any part of these Terms is found to be unlawful or cannot be enforced, the rest of the Terms will still apply.

If we do not enforce a right right away, it does not mean we have given it up.

These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, are the full agreement between you and us and replace any earlier agreements about the Services.

19. GOVERNING LAW

These Terms are governed by the laws of India. Any dispute will be handled by the courts in Mumbai, Maharashtra, subject to any right you have under Indian consumer law.

20. CHANGES TO THESE TERMS

We may update these Terms at any time by posting the new version on this page. Please check this page from time to time. If you keep using the Services after a change, it means you accept the updated Terms.
